The following terms and conditions apply to all websites and services managed and operated by Omakase Marke (hereinafter referred to as "the Site"), collectively referred to as "the Service." These terms govern the relationship between the Site and customers who use the Service (hereinafter referred to as "Users"). By using the Service, Users agree to comply with and be bound by the terms set forth below. The Site reserves the right to modify these terms at any time as deemed necessary.

This Privacy Policy outlines the handling of personal information of Users in connection with all services provided by the Site.

Article 1 (Application of Terms)

The registration process for using the Service shall be conducted by the User themselves through the registration form designated by the Site. Users shall provide accurate information for the items required during registration.

By entering the required information in the registration form and completing the registration, the User agrees to these terms and conditions.

Article 2 (Registered Personal Information)

The Site shall appropriately handle the personal information registered by Users in accordance with the Act on the Protection of Personal Information and other related laws, and manage it strictly.

The Site has established internal regulations for handling complaints and inquiries regarding personal information and will respond promptly and sincerely to such complaints and inquiries.

The Site will use the personal information registered by Users only within the following scope of purposes:

• Reception of registration related to the Service, identity verification, provision, maintenance, protection, and improvement of the Service.
• Providing information and responding to inquiries related to the Service.
• Responding to actions that violate the Site’s terms, policies, etc., related to the Service.
• Notifying changes to the terms and other policies related to the Service.
• Purposes incidental to the above usage purposes.
• Delivering various product and service information deemed beneficial by the Site via direct mail, email, and other notification methods.
• Creating trend and marketing data by analyzing and aggregating obtained information for the purpose of improving products and services.

The Site shall not modify or change personal information without prior consent from the User.

Except as required by law or with the User’s consent, the Site shall not disclose personal information that can identify the User to any third party.

Article 3 (Newsletter Distribution and Cancellation)

After registration for the Service, the Site may send newsletters (including emails related to newsletters, announcements, and administrative communications) to the User. Newsletters may include information about the Site’s activities as well as advertisements and promotions related to the Site or third parties such as partners.

The Site will use only the information registered by the User for newsletter distribution.

When outsourcing newsletter distribution to a third party, the Site shall ensure that such third party complies with this Privacy Policy.

Users may change their registration details or unsubscribe from newsletters at any time.

To change registration details or unsubscribe, the User shall follow the procedures specified by the Site via various notification methods.

Article 4 (Disclosure of Personal Information)

The Site shall disclose personal information to the User without delay upon confirming that the request is from the User, in accordance with the Personal Information Protection Law, unless otherwise stipulated by law or regulations. If no such personal information exists, the Site will notify the User accordingly.

Article 5 (Correction and Suspension of Use of Personal Information)

Upon receiving a request from the User based on (i) the personal information being inaccurate, or (ii) use beyond the announced purposes or collected by fraudulent means, the Site shall promptly investigate after verifying the User’s identity. Based on the investigation, the Site shall correct or suspend use of the personal information and notify the User accordingly. If the Site decides not to correct or suspend use based on reasonable grounds, it will notify the User of such decision.

Article 6 (Cancellation of User Registration)

The Site may cancel the User’s registration for the Service without prior notice under any of the following conditions:

• The User violates these terms and conditions.
• There is false or erroneous information in the User’s registration details.
• The registered email address is deemed non-functional.
• The User has registered using impersonation of a third party.
• Emails sent due to suspension of use of information registered by the User fail to be delivered.
• Complaints are received from third parties about unsolicited newsletters delivered to the User’s registered email address.
• Any other conduct deemed inappropriate by the Site.

Article 7 (Web Server Records)

The Site’s web server automatically collects and records the IP addresses of Users’ computers; however, these do not personally identify the Users. Unless Users disclose personal information themselves, they may browse the Site anonymously.

Article 8 (Governing Law and Jurisdiction)

The governing law for these terms shall be the laws of Japan.

Exclusive jurisdiction for first-instance disputes related to these terms shall be the Tokyo District Court or Tokyo Summary Court.

Article 9 (Procedure for Changes to the Privacy Policy)

The Site shall periodically review the operation of personal information handling and strive for continuous improvement. The Site may change this Privacy Policy as necessary and will notify and publish any changes to Users by designated methods.

Disclaimer

The Site assumes no responsibility whatsoever regarding the following matters concerning the Service:

• Damages incurred by Users from contents provided by the Service or newsletters distributed by the Site.
• Disputes arising between Users related to the Service.
• Issues related to websites or services linked from the Site that are outside the Site’s control.
• Damages arising from the User’s computer, network, software environment, etc.
• Damages suffered by Users due to suspension, interruption, or changes to the Service.

Copyright

All rights (ownership, intellectual property rights, portrait rights, publicity rights, etc.) related to all copyrighted materials, portraits, characters, marks, and other information (collectively "Contents") published in newsletters, including texts, photographs, videos, and audio, belong to the Site or the respective content providers who hold such rights. Users shall not acquire any rights to the Contents and must not infringe upon these rights. If any issues arise from violations of the preceding clause, Users shall resolve them at their own expense and responsibility and shall not cause any inconvenience or damage to the Site.
